窃电犯罪初论

【摘要】 针对程度不同的窃电行为,各级电力部门坚持开展反窃电斗争,但收效不尽人意,原因之一是对相关法律尤其刑事法律运用不足。该文则利用刑法理论对窃电犯罪进行剖析,梳理了国外反窃电犯罪的立法模式以及我国该领域的立法沿革并重点对单位窃电犯罪、窃电犯罪的量化以及类型转化和数罪并罚问题予以探讨,提出了反窃电的相应对策。更多还原

【Abstract】 With respect to all kinds of stealing power acts，though electric departm ents of all levels in sist on the an－ti－stealing power struggle，the effect is not satisfactory，due to the in adequate application of the relevan t laws，especially the criminal l aw．This paper analyzes th e stealing power crime with the theory of criminal la ws，while elucidatin g foreign legis－lation mode on anti－stealing crime a nd l egislation evolution of our nati on．The paper puts stress upon discussions abou t the corporate crime of stealing power，t he quantification of stealing power c rime and the joinder of punishments for plural crimes，and produces the correspo nding countermeasures for stealing power crim inal．更多还原
