【摘要】 文章运用关于权利的“五要素说”分析“三代人权”理论的差别 ,对于“二战”后出现的所谓“第三代人权”的内容和理论特质作了具体的剖析。强调“第三代人权”的提出是广大发展中国家从其自身的发展状况出发 ,对于西方传统的人权理论的反拨 ,它突破了西方人权理论的狭隘解释 ,扩大了人权理论的研究领域 ,推动了人权理论的多元化发展 ,是世界人权运动发展的重要成果更多还原

【Abstract】 This paper analyzes the differences among theories of “the Third Generation Human Rights” according to “the Five Elements Theory” of rights, and elaborates the contents and features of the Third Generation Human Rights that came forth after World War II. It emphasizes that “the Third Generation Human Rights” was put forward by the developing countries according to their own situation of development, and that it is a counteraction to the traditional western theories on human rights.“ The Third Generation Human Rights” goes beyond the narrow interpretation of human rights theories in the west, enlarges the research fields of human rights theories, promotes pluralistic development of human rights. Therefore, “the Third Generation Human Rights ”is an important result of the development of the world human rights movements.更多还原
