【摘要】 我国法学社团是推进依法治国、建设社会主义法治国家的不可或缺的重要社会力量。在经济全球化和“全球社团革命”的背景下,在世界大发展大变革大调整时期,在我国经济社会发展的重要战略机遇期和社会矛盾凸显期,我国法学社团发展面临着重大机遇,法学社团管理体制和内部机制面临着严峻的挑战。准确认识法学社团的性质、作用,改革法学社团管理体制,完善法学社团内部机制,建立适合我国国情的法学社团发展模式,已成为当务之急。本文立足于我国国情,立足于科学发展,从宪法的角度,通过分析社团一般理论,回顾中国法学社团的历史,考察中国法学会的历史和现状,对中国法学会的地位及法学社团的管理和发展等问题进行了较为系统的研究,提出了中国法学会法律地位的具体内涵,并提出了我国法学社团发展的三项主要建议：第一,提出了中国法学会作为全国法学社团的枢纽组织的定位,并进一步提出了形成全国学社团枢纽组织负责管理和培育法学社团的新格局的设想,分析提出了中国法学会应发挥其特殊优势,发挥出全国法学社团枢纽组织的应有的理念枢纽、资源枢纽、网络枢纽功能作用,准确把握枢纽组织与政府的关系、与法学社团的关系的建议；第二,提出了中国法学会作为中国法治思想库的定位,并进一步提出了中国法治思想库的研究目标和要求、发挥中国法治思想库的影响力的建议；第三,提出了中国法学会引领全国法学社团规范化进程的目标,并进一步提出了中国法学会内部治理的规范化,中国法学会统一引导全国法学社团的规范化进程的建议。更多还原

【Abstract】 The legal organizations in China are an important and indispensable social force to promote the role of law and build a socialist country under the rule of law. In the background of the economic globalization and the global revolution of organizations, at the time of big development, big change and big adjustment of the world, and during the period of important strategic opportunities for China’s economic and social development, and with the protruding social contradictions, the legal organizations in China not only face a major opportunity for their development, but also encounter a severe challenge for their management systems and internal mechanisms. Therefore, it has been an urgent task to precisely understand the nature and role of the legal organizations, to reform their management systems and improve their internal mechanisms, so as to set up a mode of development of the legal organizations suitable for our national situations.This paper, based on our national situations and the concept of scientific development, from the view of Constitution, by analyzing the general theories of organizations, reviewing the history of Chinese legal organizations’ development, and inspecting the history and current situation of the China Law Society, makes a systematic research on the legal status of the China Law Society and the management and development of legal organizations, then addresses the specific meaning of the legal status of the China Law Society, and puts forward three suggestions on the development of Chinese legal organizations. Firstly, this paper discusses the position of the China Law Society as the pivotal organization for the legal organizations in China. Then it submits a proposal that the pivotal legal organization is responsible for the management and fostering of the whole nation’s legal organizations. It points out that the China Law Society shall take its special advantages and play the due role of ideology pivotal, resources pivotal and network pivotal as the pivotal organization for the whole nation’s legal organizations, precisely grasp the relations between the pivotal organization, the government and the legal organizations, so as to promote the social governance and good governance. Secondly, this paper addresses the position of the China Law Society as China’s Think Tank of Rule of Law, and the research objectives and requirements of the Think Tank. It also puts forward the proposal and specific methods to expand the influence of China’s Think Tank of Rule of Law. Thirdly, the paper gives the targets of the institutionalization of legal organizations in China led by the China Law Society. It makes the suggestions on the institutionalization of internal governance of the China Law Society, the institutionalization process of legal organizations in China unifiedly led by the China Law Society, and the establishment of self-disciplinary mechanism with the regulation as the core.更多还原
