【摘要】 监禁刑在近代以来成为各国刑罚体系的中心,同时矫正罪犯使其复归社会成为监狱行刑的主旨。但是监狱行刑以将罪犯隔离于正常社会的手段,去追求罪犯再社会化的目标,从而形成了手段与目标之间的深刻矛盾。在日益开放的现代社会中,监禁刑的运行成本在不断增加,而其改造效能却令人失望。为了缓解这一问题,行刑社会化思想应运而生,主张慎用监禁刑,尽可能把罪犯放到社会上接受矫正,同时弱化监狱的封闭性,使其尽可能接近于自由社会,并扩大社会力量对矫正事业的参与,以利于罪犯回归社会。行刑社会化代表着行刑发展的国际趋向。在行刑社会化导向之下,推进我国行刑改革,已成大势所趋。本文旨在对行刑社会化思想的内涵、价值及立论基础等作系统而深入的探讨,并为这一思想在我国行刑实践的推行建言献策。正文共分八章,约16万字。第一章:行刑社会化的思想源流。本章系统梳理了行刑社会化思想的发展脉络,指出这一思想发端于刑事近代学派,二战后新社会防卫论的兴起使之最终确立与成熟。对20世纪70年代行刑社会化思想面临的冲击作了剖析,指出这一思想并未走向衰落,仍有强大的生命力。第二章:行刑社会化的内涵解读。指出人的社会化和罪犯再社会化是行刑社会化的逻辑前提。在评析各种观点的基础上,对行刑社会化的定义作了新的表述,并从理念、制度、运作三个层面对其内涵作了进一步阐述。此外,还分析了行刑社会化所蕴含的人道、民主、效益等多重价值。第三章:行刑社会化的立论基础。本章中提出:人的社会性和社会的人性是行刑社会化的人性基础;二元社会结构的形成和权利意识的勃兴是行刑社会化的现实基础;刑法学研究视角由犯罪转向罪犯,以及对罪刑现象认识趋于理性化,是行刑社会化的学理基础。第四章:行刑社会化在国外的实践及其借鉴。以英国、美国、俄罗斯、日本四国为例,介绍了这些国家在推行行刑社会化方面的立法与经验,以资我国吸收、借鉴。更多还原

【Abstract】 Punishment of Imprisonment has been the core of system of punishment in each and every country since the modern times, and the primary purpose of imprisonment is to educate and reform convicts and finally make them rehabilitate. But Punishment of Imprisonment always adopts the method of separating convicts from the rest of society to achieve its end of rehabilitation, and that makes the paradox between its means and end. To solve the above paradox, The Socialization of Execution of Punishment is put forward. The Socialization of Execution of Punishment is to reform convicts in the normal social conditions and to weaken the role of closed prisons, and make fully use of social forces to participate in the reformation of convicts so as to make it easy for them to rehabilitate. Socialization of Execution Punishment is the necessity in the development of execution punishment.
