【摘要】 人力资本产权问题研究的意义重大。从实践上看，人力资本产权制度在中国还尚未建立起来；从理论上看，人力资本理论土要研究了人力资本的形成、人力资本与经济增长的关系、收入分配关系等，而对人力资本产权的研究只是片言细语偶尔提到(贝克尔，1964，1967)。现代产权理论利现代企业理论关于企业所有权的安排主要集中在：一是古典企业的所有权的安排(阿力饮利德姆塞茨，1972：德姆塞茨，1988；哈特，1986，1990，1995)；二是股份制公司所有权安排(迈克尔·詹森和麦克林，1976；法马，1980，布莱尔，1995)。但他们这些研究强调是个人财富(非人力资本)的重要性，认为企业所有权问题主要是非人力资本所有者之间安排，而忽视了人力资本产权问题的研究。对人力资本产权问题作开拓性研究的是少数几位中国学者(张维迎，1990；周其仁，1996；杨瑞龙、周业安，1997；方竹兰，1997；何承金、唐志红，2000；李建民，1998；黄乾，2000)，上述学者丌没有全面系统地进行全方面研究，绝人部分学者是在对企业理论的探究中来阐发人力资本产权问题的。本文将人力资本理论、制度经济学、产权经济学以及现代企业理论结合起来，通过理论分析、过程描述和实证研究的方法，全面系统探讨了人力资本产权问题，初步构建了一个较儿完整的人力资本产权理论的分析框架，并对国有企业家人力资本、国家公务员人力资本、高等院校人力资本的价值实现问题进行了实证分析和研究，提出一些政策性建议，以弥补现存理论上不足利为解决现实问题提供理论依据。更多还原

【Abstract】 To study the property rights of human capital is very important. The property rights system of human capital isn’ t effectively founded in reality, especially in China. The theory of human capital was the main study in the formation of the concept and theory, the relation between human capital and economy growth and incomes distribution, scarcely concerned the property rights of human capital (Carys. Bceker. 1964. 1967). Modern theory of the property rights and enterprise think the ownership of enterprise is arranged among capital, Main idea as follows: one is the ownership of classical enterprise(Armen Alchian and Harold Demsetz, 1972; Harold Demsetz, 1988; Oliver Hart, 1986, 1990, 1995) ; The other is the ownership of shareholding corporation (M.Jensen and W. Mecklin,1976; Eugene Fama, 1980; Berler, 1995). Modern theory of the property right and enterprise think the ownership arranged non-human capital. The study about property rights of human capital wasn’ t its of vision, Only a few Chinese scholar had initiated in the property rights of human capital(Cheuug Wei Ying,1990; Zhou qu ren, 1996; Yang Lei Long, Zhou Ye an ,1997; Fang Zhu Lan, 1997; He Cheng Jin , Tang Zhi hong, 2000; Li Jian Ming, 1998; Huang qian 2000). But they studied a little about the property rights of human capital in the process of the enterprise. So in the times of knowledge economy , The property rights of human capital are 1important with respects of real and theoretical. The human capital theory. Property rights theory. Institutional economics theory and modern enterprise theory are combined. Utilizing integration of theoretical research, process description and partially empirical test. The dissertation completely and systematically discussed the property rights of human capital, and initially established the theoretic framework about the property rights of human capital, and analyzed the property rights of human capital in China. The aim of the dissertation is to remedy insufficiency of the present theory, and to provide theory basis for realization of the property rights of human capital.更多还原
