【摘要】 本文通过对《民主与法制》“法律顾问”栏目1979—2003年的2077个案例的分析,追溯当代中国的日常法律工作在法律改革25年间的意涵变迁。通过对该“法律顾问”栏目的分析,指出在这一宏大变革的25年里,中国的法律人在其日常工作中逐渐引用越来越多的法律法规,并采取越来越技术化的语言回应来自公众的问题,但这同时也增加了民众充分理解和运用法律人咨询意见的难度。这一法律系统与日常社会生活之间的沟通困境是中国法律改革出现许多问题的一个重要原因。更多还原

【Abstract】 This paper traces the transformation of meaning in everyday legal work in China over the 25 years of legal reform on the basis of 2,077 cases from a legal advice column in Democracy and the Legal System magazine from 1979 to 2003. Using this data source, the author argues that lawyers have cited more statutes and adopted more technical language in their advice to column readers, and this makes it more difficult for the readers to fully understand and make use of the legal advice. Increasing communication difficulties between the legal system and everyday life partially explains why the outcomes of the first twenty-five years of China’s legal reforms have been disappointing.更多还原
