【摘要】 我国公立中、小学校法人地位问题,是一个向有争议的问题。我们通过法人地位的立法、法人享有的权利和法人成立的条件对公立中、小学校的法律地位进行了较为深入的分析,认为在法律上公立中、小学校的地位模糊和不清晰;与高等学校法人享有的权利相比,其权利受到严格限制和约束;与法人成立条件相对照,其没有独立的经费和能够独立承担民事责任的能力。于是,我们得出我国公立中、小学校不具有法人地位的结论。更多还原

【Abstract】 The position of an artificial person of our middle and primary schools established and maintained by the government is a controversial question.We probe the question by uhe laws,rights and conditions of an artificial person,and think that not clear is the legal position of an artificial person of our middle and primary schools established and maintained by the government.As compared with the rights of universities and colleges,their rights are restricted.They have no the funds that they can govern and the capacity that they bear legal responsibility.So,we believe that our middle and primary schools established and maintained by the government are not artificial persons.更多还原
