【Abstract】 The constitutional establishment of the fundamental civil rights position is a weathercock contemporary China must face in a relatively long period of time,and it has a direct bearing on the selection and opportunity of constitutional government social route.From overall perspective,fundamental civil rights represent the soul and core of the constitution.In terms of content and structure,fundamental civil rights can be divided into dominant articles and recessive articles.In terms of paradigm symmetry,the relationship of fundamental civil rights and duties contains rich dialectics flavor.From practical viewpoint,managing state affairs according to law firstly means managing state affairs according to constitution,whose top priority is ensuring fundamental civil rights.更多还原
