【摘要】 医疗事故损害赔偿纠纷案件的法律适用在司法处理上标准迥异,往往是相类似的案件却出现大相径庭的判决结果,这其中又集中体现在精神损害赔偿和死亡赔偿金方面判决结果差异甚大。笔者认为,医疗事故损害赔偿纠纷案件属侵权之诉的应适用《民法通则》,即适用《解释》并参照《条例》、支持合理的精神损害赔偿和死亡赔偿金等诉求。更多还原
