【摘要】 依据吴思先生的潜规则理论,从刑法的视角探视,很容易发现,在刑事法领域,除了刑法的明文规定以外,还存有一些始终影响或参与刑事法律运作的规则,亦即潜藏在法律明文规定之外的潜规则,审视法律运作中的潜规则,既可以避免潜规则对明规则的肆意侵袭,更好地彰显刑法基本原则;还可以通过关注、规制合理的潜规则,使明规则与潜规则更好地契合,共同完成刑法的任务。更多还原

【Abstract】 According to the latent rule theory based on Mr.Wu,from the perspective of criminal law,It is very easy to be discovered that in criminal law domain,besides criminal law regulations,there are Some latent rules which consistently affect or participate in criminal law operation.Through examining these latent rules,wecam not only prevent them from attacking the bright rules recklessly and reveal clearly the basic principle of criminal law,but also regulate reasonable latent rules,make the bright rules conjunct with the latent rules well and complete the duty of the criminal law together.更多还原
