【Abstract】 It is inevitable that a depositor enjoys a real right over his funds in the banking account because of the valuation on real right and the distinguishing between right of creditor and real right.Therefore,in nature depositing funds contract is a mixed one by a common deposit contract and a contract on transferring the utilization right of the funds;It is not a right of creditor but a real right the depositor enjoys,and it is not the ownership of the funds but the right of utilizing the funds the bank acquires.更多还原
