论雇主追偿权
On Employer’s Recovery Right
【摘要】 随着经济的发展,雇主责任案件普遍存在,促生着对雇主责任制度的规范,相关司法解释在规定了雇主责任的同时规定了雇主追偿权,但真正实现雇主追偿权却存在困难。实务中应将雇主追偿的条件限于雇员故意和重大过错的情形,同时对雇主追偿的范围进行限制。通过对雇主责任险的拓展,积极发挥雇主责任险的作用,分担雇主责任。
【Abstract】 With the rapid development of social economy,cases concerning employer liability prevail,which accelerates the regulation of employer liability system.Some relative judicial interpretations have stipulated employer’s recovery right,but it’s not easy to carry employer’s recovery right into true execution.It’s necessary to restrict employer’s recovery right to the cases of employee’s purpose and serious fault,and the scope of employer’s recovery should be limited.Through the expansion of employer liability insurance,the function of employer liability insurance can be put into full play and employer’s liability can be shared.
