【摘要】 由于我国的国家赔偿制度起步较晚,受历史传统、观念习惯及立法体制等多方面的影响,我国国家赔偿程序制度在立法上存在着相当多的不足。作者提出,应当从以下几个方面弥补立法上的缺陷。一是我国《国家赔偿法》要明确在行政赔偿案件中先行处理为必经程序的基础上,具体规定赔偿义务机关处理行政争议时应遵循的程序性规则,以增强其可操作性;二是将现行司法赔偿确认程序设计成可选择的程序,并在人大中设立最终处理机关;三是改变各级政府分别编列赔偿预算,各自支付赔偿费用的方式,由国家财政部门统一支付。更多还原

【Abstract】 Because the national compensation system of our country started relatively late,a lot of deficiencies in legislating exist in our country’s national compensation procedure system with the influence of historical tradition, notion,custom and legislative system,etc.The author suggests that the following measures should be taken by legislation to improve the National Compensation Law.First,we should establish the foundation that the administration handle procedure in advance is the necessary procedure in the National Compensation Law, and concrete the procedure rule that the compensate organization should follow when it handles the administration controversy in order to improve its maneuverability;Secondly,turn the procedure of application into an alternative procedure,additionally,to set up terminal judging organ in the People’s Congress Institution;Finally,change the compensation budget,respective payment compensation expense in separate way of all levels of governments to unifiy the payment by the country finance department.更多还原
