【摘要】 死刑是剥夺犯罪人生命的最严厉的一种刑罚方法,其立法取向历来受到各国立法者及刑法学家的重视。从公正角度来确定死刑的分配,标准只有一个,即只可分配于所侵害的客体价值不低于人的生命价值的犯罪中最严重的犯罪。以此为标准,本文针对中国现行刑法死刑罪名设置的缺陷,提出若干存废死刑罪名的具体建议。更多还原

【Abstract】 Death penalty is the most serious punishment which takes peoples′ life;its legislation is always highly regarded by every legislator and every jurist throughout the world.From the angle of justice,there is only one standard,that is,it can only be used when a crime cause the lost of value not lower than peoples′ life.Taking this as a standard and to deal with the defects,this article gives us several suggestions.更多还原
