【摘要】 本文引入新制度经济学的不完全契约与剩余控制权概念,将TBT以及相关协议看作各国政府签定的一个有关技术性贸易壁垒的不完全契约。由于契约的不完全,从而导致了政府在技术性贸易壁垒问题上的剩余控制权。本文尝试建立起对于技术性贸易壁垒问题的新制度经济学的分析框架,并在此框架下探讨了技术性贸易壁垒层出不穷的制度根源以及政府剩余控制权的结构、特点、表现等。最后,从制度层面上给出了降低技术性贸易壁垒的相关建议。更多还原

【Abstract】 This paper introduces the concept of incomplete contract and residual control right of new institution economics, consider the TBT and related treaties as incomplete contracts signed among the governments of WTO membership, the incompletion of the contracts result in residual control rights of the governments. Based on these, we try to establish new institutional economics analysis frame to TBT, and discuss the institution causation of technical barriers to trade, and the characteristics and behavior of the residual rights of governments. Finally, we try to give some advice to reduce TBT from the perspective of this analysis frame.更多还原
