【摘要】 劳动报酬权是人权的重要内容之一。因此,认真研究农民工的劳动报酬权意义重大。从实证研究出发,农民工的工资现状是:一是农民工的工资低,二是多年未上涨或上涨幅度不高;三是最低工资太低;四是农民工的工资被拖欠的情况比较常见,讨薪比较困难。因此,有必要尽快制订《最低工资法》,提高农民工的最低工资和实际工资;通过执法保障有效的贯彻实施有关保障农民工工资的法律;制订《劳动合同法》;制定《工资支付法》;将恶意拖欠工资确定为犯罪行为;加大地方性法规的立法力度;制定《劳动监察法》,从而全面保障农民工的劳动报酬权。更多还原

【Abstract】 The right of obtaining remuneration for labor is one of the important human rights.Therefore,it’s of great significance to study the migrant workers’ right of obtaining remuneration for labor.Based on lot of cases,the current situation of migrant workers’ wages is: firstly,the level of their wages is rather low;secondly,they haven’t got wage rise for many years or the rise is fairly small;thirdly,their minimum wage is too little;fourthly,the arrear of farmer worker’s wage is rather common and it’s difficult to get it back.Analyzing the causes of the problem,it’s proposed that "Law of Minimum Wage" be drafted as soon as possible to raise farmer workers’ minimum and real wages;Effectively guarantee the implementation of laws concerning farmer workers’ wages through law enforcement.Draft "Law of Labor Contract" and "Law of Paying Wages";Defining arrear of migrant workers’ wage with evil intentions as behaviors of crime;strengthen local legislation and formulate "Law of Labor Supervision" to comprehensively safeguard migrant worker’s right of obtaining remuneration for labor.更多还原
