【摘要】 传统知识作为人类文化的历史积淀,近年来越来越受到关注。“生物海盗”行为引发保护传统知识的必要性,关于传统知识的保护方式,主要有积极保护和消极保护。在专利审查对世界新颖性的考察中,将传统知识视为现有技术,通过传统知识文献化将传统知识纳入专利审查的可检索的范围,增强确定性。本文认为对于已经进入公有领域的传统知识,专利法上应将其视为现有技术,通过对传统知识建立数据库或其他文献化形式,供审查员在进行专利审查时检索,以避免发达国家的私人机构对我国传统知识的染指和垄断。更多还原

【Abstract】 Traditional knowledge as the accumulation of the human culture history,in recent years has received more and more attention.“ Biopiracy ” initiates the necessity of the protection of tradition knowledge.About the way of the protection of traditional knowledge,there are mainly positive protection and negative protection.In the patent examnation under world novelty,regard traditional knowledge as prior art and the documentation of traditional knowledge can bring traditional knowledge into the scope of patent examination,and enhance confirmation.This article takes it that for traditional knowledge which enters into public domain,patent law should regard it as prior art through the setting of database or else documentation form,to avoide the personal organization of the developed country to bribing and monopolise our country’s tradition knowledge.更多还原
