【摘要】 我国行政追偿制度建立已有时日,但基本停留在法律层面,现实中没有得到有效执行,其主要原因就是理论研究的相对薄弱。文章通过对中法两国的行政追偿制度的比较,总结出法国的成功经验,结合我国国情,从程序设计、明确抗辩权和提供救济路径等方面提出我国当前应当变革之举,以期促进我国的行政赔偿制度的完善。更多还原

【Abstract】 Administrative recompant system of our country has been built up for a long time,but basically stayed on the legal aspect,not carrying out in reality effectively.Its main reason is the fundamental research on the theories is relatively weak.The paper contrasts Administrative recompant system of China and French,summarizes the successful experiences of France,and combines the national conditions of our country.We put forward the methods to perfect the Administrative Law including planning the programming of the rule and the contradicting power and providing the relief way.更多还原
