【摘要】 鉴于政府投资对循环经济发展的重要作用,循环经济法必须要对政府投资问题予以法定化,对包括投资的领域与范围、投资的主体与职责、投资的方式以及投资项目的监管等重要问题作出明确的规定。同时,通过循环经济基本法、专项法和法规规章三层次的立法,分别对政府投资的基本法律地位、具体领域的政府投资法律关系以及政府投资的具体运作机制做出规定。更多还原

【Abstract】 Owing to the government investment having important function on the recyclingeconomydevelopment,recyclingeconomic law must legalize the government investment;clearly regulate the field and scope,subject and responsibility,method of investment and the supervise of investment item and etc.Meanwhile,through three levels of lawmaking which are recycling economy basic law,special law and codes and rules,we should also regulate separately the basic legal position of government investment,the legal relation of concrete field of government investment and the concrete operation mechanism of government investment.更多还原
