【摘要】 奥运志愿服务是奥运会重要的组成部分,北京奥运志愿者招募工作业已启动,如何对奥运志愿服务进行管理与北京奥运的成败息息相关。法律是人类社会具有最高效力的规则体系,将北京奥运志愿服务管理纳入法制化的轨道不仅能够赋予管理规则最为刚性的约束力,从而保障志愿服务的高效有序进行,而且能够提升民众对奥运志愿服务的认识,为更为广泛的志愿服务立法提供理论储备和实践支持。立法过程中应坚持以人为本,强调民众参与的广泛性和长期性,尊重奥运规则,吸收国外经验,突出中国特色。其立法架构应当包括立法目的、奥运志愿服务概念的界定、志愿者管理组织和志愿者权利义务、法律责任以及救济途径等基本内容。更多还原

【Abstract】 The volunteer service plays a very important role in Olympic Games. The recruitment of volunteers for Beijing Olympic Games has started and how to manage the Olympic volunteers has a close relationship with the success of Beijing Olympic Games. Since law is considered as the most powerful regulation system, legislating Olympic volunteer service can not only ensure Beijing Olympic Games’ smooth and efficient operation with its powerful binding force,but also promote people’s cognition of Olympic volunteer service,so as to lay a foundation of theories and practice for the comprehensive legislation of volunteer service. In the process of legislation, the principle of people-oriented and the extension and long-term participation by the public must be abided, the Olympic regulations must be respected and the Chinese characteristics must be kept while taking in foreign experiences. The general frame of the legislation should include the legislative purpose,the definition of Olympic volunteer service,the respective rights and duties of volunteers and volunteer service organizations, the legal responsibility and ways of defending one’s rights.更多还原
