【摘要】 关于土地承包经营权主体,我国法律规定不尽一致,学者们的看法也不相同。其实,以家庭承包方式取得土地承包经营权的主体形式上是农户,实质上是本集体经济组织的成员;而以其他承包方式以及流转、继承方式取得的土地承包经营权的主体则具有复杂多样性。我国物权法应在《农村土地承包法》基础上完善对土地承包经营权主体及相关方面的规定,以增强法律的可操作性和对权利人权益的保障性。更多还原

【Abstract】 In China,legal rumes are inconsistent concerning the subject of the land contract operation right,and scholars do not agree with each other,either.Actually,though the subject of the land contract operation right obtained in the way of household contracts is seemingly the peasant household,the true subject is the member of the collective economical organization.As to the subjects of the land contract operation right obtained in other contracting ways or by the circulation and inheritance of the land,things are more complicated.The future law of ownership right of China should improve the correlative stipulations concerning the subject of the land contract operation right on the foundation of the Rural Land Contract Law,which will strengthen the legal feasibility and guarantee the rights and interests of the people.更多还原
