我国公务员职务保障权的司法救济

【摘要】 维护公务员的人性尊严、保障公务员的权利是当代各国人事制度的共同趋势。公务员职务保障权救济制度实质上既是对公务员权益的保障,又是对公务员人事管理权力的监督和约束。文章着重在我国现实的政治、法律、行政和社会背景下,探讨建立公务员职务保障权司法救济制度的必要性及可行性,并就确立我国公务员职务保障权司法救济制度提出立法建构的设想,指出应当遵循的原则和需要注意的问题。

【Abstract】 To defend the dignity of public servants and protect their rights is the common trend of public personnel systems in the world nowadays.The essence of the remedy system by the right of official guarantee is not only the guarantee for the civil servants’ rights and interests,but also the one for the intendance and restriction towards public personnel power.considering the Chinese background of politics,law,administration and society,this paper emphasizes the studying of the necessity and possibility of the judicial remedy system of the public servants’ right of the official guarantee in China.It puts forward the legal construction for the judicial remedy system of the civil servants’ rights of the official guarantee in China and stresses the principles and problems relevant.
