论刑事诉讼理念中的价值冲突与平衡——以实体正义价值和程序正义价值为视角
Conflict and Balance of Value in Criminal Prosecution Idea:Taking the Entity Just Value and the Procedure Just Value as the Angle of View
【摘要】 刑事诉讼理念包括实体正义理念和程序正义理念。刑事诉讼实体正义价值和程序正义价值存在冲突,即二者往往难以同时实现,解决这一矛盾的关键是把程序置于优先的地位。
【Abstract】 The criminal procedure idea includes the ideas of justice of entity and justice of procedure.Sometimes there are conflicts between them.The key to solving the conflicts to be paid more attention to justice of procedure.
