【摘要】 中国法制现代化的重要任务之一就是农村社会的法制现代化,但这种理想与中国“城乡二元结构”的国情之间存在着巨大的差距。尽管人民调解是中国传统的纠纷解决机制,但是其在缓解现代农村社会法治需求困境方面仍具有不可或缺的作用。中国法制现代化应是建立在现代中国社会生活和经验之上的推进而非概念中的展开,因此,人民调解机制可以视为中国法治深入农村社会的有效渠道,可以视为现代法律进入农村社会的窗口。更多还原

【Abstract】 One of the most important tasks of the Chinese Legal system’s modernization is to modernize the rural area.But this ideal is conflicting with the dualistic situation of the urban and rural in China.The people’s mediation is playing an important role in mitigating the needs for the rule of law in the vast Chinese rural area though it is the traditional resolution for disputes.The Chinese legal system’s modernization should be grounded on the experiences of the Chinese reallife society,but not on the abstract conceptions.The people’s mediation could be the effective means and window for the modern rule of law to infiltrate the vast Chinese rural area and society.更多还原
