【摘要】 本文根据法律多元论揭示了我国社会客观存在的国家法与民间法多元法律格局。文章运用乡村都市化理论分析了我国乡村都市化的实质,指出乡村都市化侧重于村民生活方式和价值观念的变化,国家法制度和观念由此大幅度进入都市化的乡村;考察了乡村都市化背景下发生的典型纠纷及其解决方式;分析了民间法与国家法的文化背景,从而解释了这些纠纷及其解决方式实质上是民间法与国家法之间的文化冲突;最后提出对策建议,在法的制定和法的实施上通过文化整合来处理冲突,建设和谐社会。更多还原

【Abstract】 The paper reveals the multi-law situation of coexistence of state law and folk law in China,probes into the essence of urbanization of rural areas in China,then points out that the emphasis of urbanization in rural areas is laid on the transformation of villagers’ life style and their concept of value,thus the state law system and concept widely enter into the urbanized rural areas.The paper also discusses the typical dissensions and resolving modes in the background of urbanization.By analysing the cultural background of folk law and state law,the author thinks that these dissensions and resolving modes actually reflect the cultural conflict between state law and folk law.At last,the author suggests that cultural integration should be adopted in the legislation and execution of law to solve the dissensions and build a harmonious society in China.更多还原
