【摘要】 将对私有财产权的保护写入宪法,是2004年修宪的一项重要内容。私有财产权的宪法保护与宪政建设有着密切的联系,保护私有财产权加快了我国宪政建设的步伐,体现了民主自由和个人自治,明确了政府权力与公民权利的界限,同时也以法律的形式保障了市场经济的健康发展。但是,把对公民私有财产权的保护写入宪法只是实行法治的第一步,还存在很多不容回避的现实问题有待进一步研究。更多还原

【Abstract】 It was an important issue that Constitution protect people’s private property rights of constitutional amendment in 2004.The rules and protections of “Private property rights” has a long history in China。“Constitutional protection of private” accelerates our constitutional construction and embody the freedom and the autonomy of the individual, defines the limit between government power and citizen rights. It also ensure the well-development of market economy. It is only the first step of nomocracy to protect citizens’ private property in Constitution; there are many practical problems to be solved.更多还原
