论区分所有建筑物共用部分的专用使用权
On Exclusive Right to Use of the Common Part of Buildings
【摘要】 对区分建筑物共用部分的利用,依建筑物区分所有权之法理及各国立法与实践,应由各区分所有权人依合理的方法共同使用,亦可通过设定专用使用权由特定区分所有权人或特定第三人专属独占使用。本文主要从专用使用权的客体、设定方式、性质、行使及专用使用权人的成员权等方面对专用使用权的相关问题进行讨论。尤其是对专用使用权性质的认定,提出了全新的见解和主张。
【Abstract】 According to the theory of condominium ownership and legislation and practice in other countries,each owner of the buildings should utilize the common part of the buildings together in a reasonable way, or the exclusive right to use may be vested in a specific owner or a specific third person. This article mainly discusses the exclusive right to use from such perspectives as the object, the way to vest, the nature and the exercise of the exclusive right to use. More importantly, the article puts forward a new standpoint regarding the legal nature of the exclusive right to use.
