【摘要】 不断发生的大学生因考试舞弊而受到严厉处罚,继而把学校告上法庭,高校在处罚作弊学生时由于程序瑕疵而败诉,昭示了校园领域正当程序缺位问题。本文通过透视高校学生考试作弊处罚对正当法律程序的要求,明确提出完善惩罚学生考试作弊的对策与建议:设立专门的申诉机构和听证机构;尽早出台全国统一的《考试法》;处罚时应遵循正当法律程序,尊重和保障学生之合法权益。更多还原

【Abstract】 Nowadays,some college students are punished severely by their colleges for test cheating and then these students appeal their colleges to the court.As a result,these colleges often lose a lawsuit for it because there are some slight defects in this punishment procedure.It is clear that there is a vacancy of right procedure in this punishment.This article,through the requirement of right legal procedure of punishing test cribbers,proposes some explicit suggestions :(1) setting up special organizations of appealing and hearing of witnesses;(2) appearing a national Test Law as soon as possible;(3) Colleges should follow a right legal procedure when punishing test cribbers so as to protect and respect the students’ legal rights and interests.更多还原
