司法鉴定概念内涵探讨
The Discussion of Expert Testimony-Concept and Connotation
【摘要】 司法鉴定的概念存在多种表述方法,由于对其具体内涵的认识不同,造成了对概念认识上的混淆。为此,应从司法鉴定的基本属性和基本功能两方面对司法鉴定的内涵予以分析,从而得出司法鉴定的定义。
【Abstract】 There are many explainable method for the definition of expert testimony.The different understandings for its concrete connotation have caused the confusion in concepts.Therefor we should make definition for legal system’s determination from basic nature and function of legal system.
