【摘要】 近年来,我国频频遭受外国特别是欧盟提起的反规避调查立案,对我国对外贸易及产业发展产生了深刻的影响。我国应在认识反规避措施理论上的合法性的同时,也要认识到与歧视性反倾销相关的反规避措施具有双重不公正性。并在认清反规避措施对我国影响的基础上,掌握反规避措施的特点及有关国家的相关立法。同时完善我国反规避立法,促进劳动密集型产业结构升级,以达到有效应对的目的。更多还原

【Abstract】 Recently, China has frequently encountered anti-circumvention investigations proposed by other countries, especially EU, which has imposed great influence on our foreign trade and related industries. We should know not only the legitimacy of anti-circumvention measures in theory, but also the double non- legitimacy of anti-circumvention measures which is related with discriminatory anti-dumping acts. Moreover, with a better understanding of the influence of those measures on China, we should be aware of its characteristics and relative national legislation. China’s legislation on anti-circumvention should be improved to upgrade the construction structure of labour-intensive industries so as to be able to deal with these problems.更多还原
