英国法上承运人凭正本提单交货的责任
On liability of delivery of goods against surrending original bill of lading by carrier in British maritime case law
【摘要】 从英国海事判例法的角度对凭正本提单交货问题进行分析,提出承运人凭正本提单交货的严格责任原则,并对其影响、适用和发展进行研究,明确承运人凭正本提单交货的责任.
【Abstract】 The delivery of goods against surrendering the original bill of lading is elaborated in British maritime case law.The principle of the carrier’s strict liability of delivery of goods against surrendering the original bill of lading is set forth and its effect,application and development for clarifying the carrier’s liability are analyzed.
