【摘要】 示范法是由学者、专家或由其组成的职业团体、学术团体草拟的法律文本,用以推荐给各法域在立法时予以借鉴或采纳,其主要作用体现于不同法域之间的法律统一化过程中。美国在国际社会立法运动中的呼吁和努力是示范法走向国际化的重要原因,全球化对国际社会的各个层面产生了重大影响,使更多的领域强化了统一化的认识,从而给示范法的运用提供了日益广阔的空间。示范法自身处在发展完善之中,并呈现出若干发展趋势。更多还原

【Abstract】 Model law is the legal text drawn by scholars, experts or academic groups for the use of reference or adoption in legislation, which plays its role in the unification of law across different legal spheres. The appeal and efforts made by the United Sates in the international social legislation movement is the important cause for the internationalization of model law. Since globalization has been exerting its influences on various areas of international society and urging the cognition of unification in more fields, the use of model law has been afforded extensive space. Model law itself is on the way towards development and perfection, and some developing tendencies are being presented.更多还原
