【摘要】 针对《人类辅助生殖技术管理办法》第3条对代孕技术行使的禁止性规定,从医学、法律、道德三个层面分析无妊娠能力妇女的生育权问题,认为她们也应该享有生育权,而禁止使用代孕技术则阻碍这类女性的生育权的实现,构成了对生育权的侵犯,法律应当从维护无妊娠能力女性生育权出发对相关规定予以修正。更多还原

【Abstract】 In Management Measures of Human Auxiliary Reproduction Technology,article 3 prescribes a ban on surrogacy.The paper accordingly analysed,from the aspects of medicine,law and ethics,the reproductive right of infertile women,holding that they are to enjoy the right.It considered that to forbid the auxiliary reproduction technology would infringe their right,so the regulations must be revised.更多还原
