【摘要】 隐性超期羁押是超期羁押的一种,与显性超期羁押相对应,是指采用违反法律的手段,规避刑事诉讼法律的办案期限,以形式上的不超期掩盖实质上的超期羁押,包括无期羁押型、借期羁押型和自决、自批、自审型三种类型。其产生的原因主要有主观和客观两个方面。解决隐性超期羁押的具体措施有:1、转变执法人员的执法观念,树立执法为民的理念;2、修改刑事诉讼法,建章立制;3、加强对执法人员道德操守和业务素质的教育和培养,提高他们执法为民的本领。更多还原

【Abstract】 The hidden extended custody is a extended custody which locks up the suspicions or the defendants through violating law and evading deadline of Criminal procedural law and no surpassing the legal time in form. The hidden extended custody includes no-time custody lending time custody mutual and custody of self-deciding,self-approving,self-judging.
