【摘要】 各国对于专利产品平行进口问题,有不同的理论和态度。一些学者基于“权利国际穷竭”原则或“默示许可”原则,以及国际贸易自由化对于商品自由流通的需要,得出允许平行进口的观点。而另外一些学者根据“权利国内穷竭”原则以及专利权的地域性得出应当禁止平行进口的观点。我国应从维护本国利益出发,准许专利产品平行进口。更多还原
