略论我国不动产登记制度若干问题

【摘要】 不动产登记制度系物权法之公示公信原则具体体现,亦为现代繁荣商品经济社会交易安全之使然。我国现有的不动产登记方面的规定可谓是“问题重重”,实难以适应现实经济社会发展之需求。前不久通过的物权法草案对此规定甚为粗糙,仍有不少缺憾。不动产登记查询制度、异议登记制度以及不登记损害赔偿制度在立法方面仍然存在一定的问题。

【Abstract】 Real estate registration system is the specific embodiment of the principle of making public and honesty of real right law,and it’s also the need of prospering exchange security in commodity economy society.There are lots of problems in our country’s present stipulations of real estate registration,which is difficult to meet the need of economic and social development.There are still many defects in the real estate registration system stipulated by the real right law adopted shortly before.Certain problems still exist in inquiry system of real estate registration,objection registration system as well as compensation system of no-registration.
