【摘要】 在我国证据种类中,鉴定结论因其较高的证明力,在具体审判工作中起到了举足轻重的作用。我国现今司法鉴定体系较为混乱,在司法鉴定活动中明确法官权限具有重要实践意义。本文从法理上分析了法官在司法鉴定活动中的应有地位,同时借鉴外国立法例,结合我国实际提出了相关的立法建议。更多还原

【Abstract】 In the evidence types of our country,because of its higher proof strength,the appraisal conclusions play the pivotal role in the concrete administration of justice.Judicial appraisal system is so chaotic that making the judge jurisdiction in judicial appraisal clear has the important practice significance.This article analyzed judge’s proper status in judicial appraisal basing on the legal principle theory of law,meanwhile,profited from the legal regulation of foreign country and unified our country situation,put forward the related legislation proposal.更多还原
