【摘要】 法律是社会利益资源的分配书。在社会利益资源总量特定的情况下,为了充分维护普通民众的利益和权利,必须控制国家公共权力部门的权力,防止因其滥用而侵犯民众的权利。法律既维权(利),又控权(力),是“双刃剑”。良法和法治的核心和基础是充分体现和维护广大民众的权利,而控制国家公共机关的权力则更是其中的关键。中国的经济体制转轨和治国方略转型过程的实质就在于逐步控制权力,否则改革寸步难行。随着改革不断深入,控权与反控权的斗争会愈加激烈。必须高度重视和强化转型时期法律的控权使命。更多还原

【Abstract】 The distribution of social interest resources is based on legislation. If the totals of social interest resources are invariable, we must control the power of public authorities to prevent the abuse of powers and protect the interests and rights of common peoples. Legislation act as dual effects, one is right-defending; the other is power-controlling. The core and base of legislation is the protection of the right of common peoples and the power-controlling of public authorities. The reform would meet troubles if the power of public authorities is unlimited. We must pay more attention to the power-controlling mission of legislation in contemporary transform period.更多还原
