【摘要】 通过比较、分析国外刑事法律对犯罪组织特征的规定,犯罪组织应当具备以下几个特征:(1)人数较多;(2)以谋求经济利益为目的;(3)违法犯罪行为具有暴力性;(4)组织程度高。而秘密性和腐蚀性不应当成为犯罪组织的法定特征。我国刑法关于黑社会性质组织应当“具备一定的经济实力”的规定不合理,应当加以修改。更多还原

【Abstract】 Compared with the provision of foreign criminal law,a criminal organization should has following features:first,it has relatively large number of members;second,it pursues the goal of economic benefits;third,it commits illegal or criminal acts through violence;fourth,it is well organized.However,secrecy and bribe should not be regarded as legal features of criminal organizations.In addition,the regulation of "having a certain economic power" for defining a underworld in our criminal law is not at all reasonable so that it should be ratified.更多还原
