【摘要】 普通法法系的判例法作为一种独特的法律形式,蕴含着法的稳定性与灵活性的统一、公正性与效率性的统一、监督与民主的统一以及内容与社会环境的契合等方面的法律价值。鉴于判例法的价值合理性,民法法系越来越重视通过判例的形式对既有制定法进行补充和改进,同时,中国也应该大力借鉴判例法并在制定法的框架下有效发挥判例的辅助作用。更多还原

【Abstract】 As a unique legal form, the case-law represents law value such as the unity of stability and flexibility, the unity of fairness and efficiency, the unity of law surveillance and democracy and the agreement of law content and social environment. In view of the value rationality of the case-law, the civil law legal system carries on more improvement and supplement according to the legal precedent form.
