【摘要】 近年来不断发生的学生诉高校不当处分案反映了高校在行使处分权时存在诸多问题,学生的受教育权容易受到高校不当处分地侵犯,两者之间的冲突加剧。结合新出台的《普通高等学校学生管理规定》,从高校处分权和学生受教育权入手,分析两者冲突产生的原因,提出相应的解决对策以实现两者的利益平衡。更多还原

【Abstract】 In recent years,more and more students sue colleges for improper punishment,which reflects many problems in enforcing punishment right of colleges.Education-receiving rights of students are easily infringed by colleges’ improper punishment and the conflicts become more serious.Based on Student Management Regulations of General Colleges and Universities and on punishment right and education right,this paper analyzes the reasons for the conflicts and gives related suggestions for realizing interests balance of both parties.更多还原
