【摘要】 用经济学的概念、方法和理论来具体分析经济法决策、实施及反馈3个层次的相关法律制度及其经济性成因,有助于指导经济法的运行及其经济功能的发挥。经济法运行的非均衡现状,既有其内部非均衡经济法对立变量之非均衡与经济法行为之非均衡,又有其外部非均衡经济法与民、商、行政法间的非均衡。这种非均衡的经济性成因在于经济法制度安排和制度结构的不合经济性和不具选择性。经济法权力资源的界定不清、信息的不对称及其公共物品属性是经济法有效运行的障碍。因而,经济法决策机制的制度化、实施层次的制度约束及信息反馈机制的建立是经济法有效运行的保障。更多还原

【Abstract】 Using concepts,methods and theories of economics to analyze legal systems about policy-making implement and reaction of economic law and uncover their economic causes helps for directing the operation of economic law and the performance of economic functions.The in-equilibrium present of the economic law operating,includes the interior in-equilibrium-opposite changing quantities and behaviors in economic law,and also includes the exterior one between economic law civil law and administrative law.What cause the present is in that institution arrangements structures do not go with economy principle and options.Confused definition of the resources of public right,un-equality of information and characteristics as public goods are obstacles to economic law’s effective operation.Thus,institutionalization of the policy-making mechanism, institutional bond of the implement stage and establishment of the informational reaction mechanism can ensure the economic law effectively operating.更多还原
