【摘要】 新闻舆论监督要求司法审判公开进行 ,要求对司法审判进行公开评论和报道 ;而司法独立则要求法官审判案件独立进行 ,不受任何组织、个人的干涉 ,包括舆论的干涉 ,新闻舆论监督与司法独立之间的二元悖论由此产生。但舆论监督与司法独立之间存在着矛盾和冲突 ,并没有本质的、不可避免的、不可调和的对立和矛盾 ,也不存在所谓必然层面上的冲突。只要对二者发挥作用的范围和方式进行合理的调整和配置 ,舆论监督与司法独立是能够和平共处的 ,在二者之间是能够形成良性紧张、保持合理张力的理性态势的更多还原

【Abstract】 Public opinion’s supervision needs public trail,which should permitted to be reported and commented on openly.While the judicial independence requires judges adjudicate the cases independently,excluding the intervention of any organs and persons including the public opinion.Thus comes into being the confliction of the two.This article studies the nature and the function of them and the cause of their confliction.By defining rationally their scope,it hopes to achieve the harmony of them.更多还原
