【摘要】 本文比较、分析了海峡两岸各自的留置权制度立法在留置权概念、留置权的适用范围、留置权的成立要件及留置权消灭和行使上的差异,指出了两岸立法各自的优点和劣势。认为台湾留置权制度有了许多先进的作法值得借鉴。以后在大陆对留置权制度进行立法修改时,可以借鉴台湾立法中已经成熟的经验,使祖国大陆留置权制度适应社会经济的发展及人民生活的需要。更多还原

【Abstract】 The artic compares the lien system between mainland and taiwan of china.A nalyses the difference of concept,applicable range,constructing factors and end of lien betwe en main -Land and taiwan.points out the advantage and defect of them.through the comparision,We find out lots of advantage of taiwan which is worth learning for us.In the futur e,we can accept the mature experience of taiwan to improve the lien system of mainland,and make it adjust to the development of economic and meet the peoples’ needs.更多还原
