【摘要】 目前,我国学界对法哲学的理解很不一致,一部分人认为法哲学就是法理学,或法哲学是关于理论法学的一个组成部分,而另一部分人则认为法哲学是哲学的一个分支,或法哲学是法学与哲学的交叉学科。究其原因,就在于对法哲学研究对象的不同理解。文章运用概念分析法对法哲学内涵进行解剖,明晰了我国当前法哲学的主要研究对象,从而逻辑地确立了法哲学的学科性质和地位。更多还原

【Abstract】 Nowadays,scholars have different opinions on legal philosophy in China. Some of them regard legal philosophy as jurisprudence or ingredient of the theoretical law, yet others consider legal philosophy to be a branch of philosophy or an intersect subject of jurisprudence and philosophy. This results from different opinions on the object of legal philosophy. The paper discriminates the opinions on legal philosophy by analysing the definition, explicits the object of legal philosophy and logically establishes the character and place of subject.更多还原
