对开放教育刑法教学中中止犯与其他犯罪形态竞合的思考
Meditations on the Combination of Suspented Crime and Other Forms of Crimes in the Open Eudcation of Criminal Law
【摘要】 犯罪的中止形态在多数情况下是单独存在的 ,但在有些情况下可能与其他犯罪形态发生竞合关系。其中中止犯与既遂犯的竞合、中止犯与不能犯未遂形态的竞合是较常发生的
【Abstract】 The suspended crime exists alone in most cases.But in some cases it may be combined with other forms of crimes.It is common that the suspended crime combines either with the completed crime or with uncompleted crime.
