【Abstract】 Comparative studies of law culture of China and western, evolved around the respond of western impact and legal modernization of China, has been more one hundreds of years. To many scholars make contributions to this field. In the study field, there are different discourses relevant to different considerations developed in different times. Today, this task has special significance. We should re-see difficulty of this task and seek new approach.
