公民劳动权的立宪思考
Constitutional Considerations on Citizens’ Right to Labor
【摘要】 1919年德国的《魏玛宪法》首创劳动权为宪法权利之先河。随后 ,世界上大多数国家都基于维护社会秩序稳定的需要 ,把劳动作为公民的一项基本权利载入宪法。从理论层面来看 ,劳动应是公民的一项法律权利 ,国家作为义务主体应积极创造条件 ,满足人们的就业需要。因此 ,无论是从世界各国宪法的立法实践来看 ,还是从公民劳动所应具有的法律性质来看 ,把劳动作为公民的一项权利立法是合理的选择。
【Abstract】 Citizens’ right to labor was first constitutionalized in German Weimarer Verfassung in 1919. Afterwards, labor has been considered as one of the constitutional rights in most countries of the world in order to maintain the social order and stability. Theoretically , labor ought to be one of the citizens’ legal rights. Any states, as the duty main body, ought to exert themselves to satisfy people’s need. Hence, in terms of the legislative practices in every country and the legal features peculiar to citizens’ labor, it is reasonable to regard labor as one of the constitutional rights.
