【摘要】 本文通过比照国外英美法系和大陆法系关于竞业禁止制度的立法和司法实践 ,分析了我国刑法中非法经营同类营业罪的立法宗旨和现实意义 ,并结合公司法中关于竞业禁止制度的有关规定 ,指出刑法与公司法中有关竞业禁止的规定是互为补充的。同时 ,本文也指出了我国在竞业禁止制度上应当完善之处。更多还原

【Abstract】 The paper analyzes the legislative purpose and practical significance of the illegal operating of kindred business crime in Criminal Law by comparing with the relevant legislation and judicial practice of the system of forbidding of competing business in both Anglo-American law system and Continental law system. Combined with regulations settled in Corporation Law, the article points out that Criminal Law and Corporation Law are complemented to each other on the issue of forbidding of competing business. Meanwhile, the paper also presents some advice about the consummate of the regulations and law of China.更多还原
