【Abstract】 Agent provacateur is pointed to the conduct of instigating others to practice a crime for purpose of framing others with the final meaning of attempted crime.In the agent provacateur the abettor and the incited person do not constitute the joint crime ;The agent provacateur is different from the instigator in the respects of subjective intention and the criminal appearance,thus can’t be treated as the instigator.But the behavior of agent provacateur has severe social harm and should be penalized.更多还原
